ON THE JOB INJURIES
New York State Workers’ Compensation Law provides for the payment of medical and hospital bills, as well as lost wages (subject to maximum benefits permitted by law), and other benefits for an employee injured in the course of employment. However, New York law provides that the employee injured in an “on the job accident” loses the right to sue his or her employer for pain and suffering, and other monetary damages, which a New York accident victim would usually be entitled to seek from the negligent party responsible for causing the accident.
In many on the job injuries, the cause of the accident was the negligence of the injured worker’s employer or coworker. In those instances, the injured employee may be unable to recover money damages for the injuries sustained, and might therefore be limited to the Workers’ Compensation benefits.
In many other work related accidents however, the dangerous conditions that caused the accident may be the result of a third-party’s negligence or carelessness. In those instances, the injured employee may have the right to sue the negligent entity for monetary damages, including pain and suffering, hospital and medical expenses and lost earnings not reimbursed or paid by Workers’ Compensation benefits, and loss of services sustained by the injured worker’s spouse.
If that person or company was negligent, and those acts or omissions caused or contributed to the worker’s accident and injuries, that “third-party” may be responsible (partially or entirely) for the injuries sustained by the injured worker. Examples of potential non-employer defendants who might be legally liable for the worker’s injuries include a property owner who failed to repair or maintain broken steps, doors, walkways, or parking lot; a contractor who installed an uneven or lifting floor that the worker tripped on; a cleaning company that washed a floor at the place of employment, and neglected to place Wet Floor signs, causing the employee to slip and fall; a manufacturer of defective equipment that injured the employee; and other people or companies who created dangerous conditions that caused the accident.
